Recently, real estate professionals, including those seeking a good condo, have been concerned by the news of the revocation of condominium construction permits. Even after construction is completed, sold, and occupied, the revocation can still be retroactively announced. This issue serves as a good reminder for those planning to purchase a condo to understand which condos are legal and do not pose a risk of demolition. Important considerations include:

Is the condo properly licensed?

Condominiums that do not face the risk of demolition must be properly licensed, have a building permit number, have passed an Environmental Impact Assessment (EIA) approval, be registered as a condominium, and comply with various safety regulations, such as fire protection systems, wastewater treatment, exterior space designations, and building setbacks.

Construction must comply with safety regulations.

Construction safety regulations must not only be met when the application is submitted, but must also be met once construction is complete. Important points to consider regarding construction safety regulations To help us make a simple decision when deciding to purchase a condo, here are some guidelines:

- High-rise condos exceeding 23 meters must be at least 6 meters from the property line of another person.
- Low-rise condos exceeding 8 stories must be at least 2 meters from the property line of another person.
- High-rise condos exceeding 23 meters or with a total building area of 10,000 square meters must have outdoor space of at least 30% of the land area on which the building is located.
- Low-rise condos exceeding 8 stories must have outdoor space of at least 30% of the area of any floor on the highest floor.
- Both high-rise and low-rise condos require a setback. Buildings adjacent to public roads less than 6 meters wide must be at least 3 meters from the center of the public road. Buildings exceeding 2 stories or 8 meters tall must have different setback limits based on the width of the road.
- High-rise condos also specify the width of the land in front of the building and the size of the road. For example, a condominium with a total floor area exceeding 30,000 square meters must have at least one side of the land at least 12 meters long, bordering a public road at least 18 meters wide, extending continuously until it connects to another public road at least 18 meters wide.

In reality, there are many details regarding the regulations regarding condominium construction permits. It's highly likely that buyers will not thoroughly examine them and not fully understand the legal provisions. Even if they do, it's difficult to verify them on their own, as a simple glance may not always be accurate. Therefore, the overall decision to purchase a condominium is to avoid future problems, such as having a building permit revoked. Therefore, it's important to choose a project developed and constructed by a professional developer with extensive experience in condominium construction and a credible contractor. At the very least, if a problem arises, we, as the buyer, will receive the most comprehensive and effective care, resolution, and protection of our rights, preserving our interests, and receiving the most appropriate compensation.
