What are the requirements for foreigners renting a condo?

Section 38 of the Immigration Act B.E. 2522 (1979) stipulates that a house master, owner, condo owner, possessor of a dwelling, or hotel manager who accommodates a foreigner—provided that foreigner has permission to stay in the Kingdom temporarily—must notify the competent official at the immigration office responsible for the area where the dwelling or hotel is located. This notification must be made within 24 hours of the foreigner’s arrival.
This means that foreigners are permitted to rent houses or condominiums for residence, provided that the process is carried out in accordance with the law.

Procedures for renting a condo to a foreigner

The condo owner is required to report the details of the foreign tenant to the local immigration office or police station. The foreign tenant must hold valid permission to stay in the Kingdom temporarily for the duration of their residency.
Additionally, the landlord must submit the foreign tenant's information and documents to the condominium's juristic person office for record-keeping, in compliance with Condominium Juristic Person Regulation No. 002/2555 regarding the use of units for residential rental purposes.

The landlord must also prepare the necessary documentation for the rental, which includes:
1. A copy of the foreigner's alien identification card or passport.
2. A copy of the certificate of residence for the tenant and any accompanying persons staying in the unit.
3. A copy of the notification of foreigner accommodation (receipt of notification). At the Immigration Bureau

When foreign nationals rent a condominium or house, or stay in a hotel, guesthouse, apartment, rental home, or any other establishment with more than four guest rooms, the operator must make copies of the guests' passports and visas, complete the TM.30 form, and submit a report to the Immigration Bureau.

There are three methods available for property owners and operators to submit the TM.30 report:

1. Online reporting: This is the easiest method. Property owners must first register for a username and password via the Immigration Bureau's website.
2. Reporting in person: After the foreign resident fills out the TM.30 form, the property owner must prepare copies of the house registration and their national ID card to submit at the local Immigration Bureau office.
3. Reporting in person by the foreign resident.
Failure by the property owner or host to submit the TM.30 report carries a fine not exceeding 2,000 Baht (for hotels, the fine ranges from 2,000 to 10,000 Baht), in accordance with the penalties prescribed in Section 77 of the Immigration Act B.E. 2522 (1979).

Key factors influencing foreigners to rent condominiums

There are several important factors to consider when renting out a condominium to foreigners:

1. Location
Proximity to comprehensive amenities is crucial. Houses or condominiums located along mass transit lines (such as the BTS or MRT) attract significant interest from foreign tourists, as these locations offer convenient transportation options. It must also be located in an area with amenities such as shopping centers, malls, food courts, and entertainment venues.

2. Condo Styles
Regarding the types of condos preferred by foreigners—particularly Europeans and Americans—who come to work and reside in Thailand long-term, most seek units that are airy and minimalist, allowing them to decorate according to their own tastes.
Executive-level tenants generally prefer spacious units: at least 100 square meters for 2-bedroom condos and 150 square meters or more for 3-bedroom condos.
Foreigners renting alone often look for smaller units, whereas Asian tenants typically prefer fully furnished units that are ready for immediate occupancy.

3. Comprehensive facilities and high security
Foreigners moving to the country for work—especially those with families—tend to prefer condos or houses located near international schools and airports. They look for properties with communal facilities like playgrounds and swimming pools, as well as robust security systems. Key features include secure perimeters that restrict unauthorized access, comprehensive CCTV coverage, and a safe, reputable community atmosphere. A high concentration of other foreign tenants is also considered a significant plus.

4. Smart Home technology
In the era of living amidst the COVID-19 pandemic, foreign tenants look for "Smart Home" technology that enhances convenience and hygiene within the property. Features such as automatic door openers and keycard systems are highly valued, as they minimize physical contact in high-traffic communal areas, thereby reducing the risk of disease transmission.

With this information in mind, anyone planning to invest in a condo for rental purposes should carefully review their checklist and prepare all necessary documentation. It is also crucial to research the specific needs of foreign tenants—such as preferred locations and desired surrounding amenities—to ensure you do not miss out on this target market.
