Foreign ownership of condominium units

Selling condos to foreigners is another popular form of real estate investment, as foreigners have high purchasing power, making it highly unlikely to succeed. Furthermore, there is a large target group of foreigners who want to own condos in Thailand. However, there are certain criteria and conditions for selling condos to foreigners in Thailand, which must be carefully considered. Foreigners eligible to own condominiums in Thailand must meet the following criteria:

1. Must be a foreigner permitted to reside in the Kingdom under the Immigration Act B.E. 2522 (1979).

2. Must be a foreigner permitted to enter the Kingdom under the Investment Promotion Act B.E. 2520 (1977), Sections 24 and 25.

3. Must be a juristic person as defined in Sections 97 and 98 of the Land Code. Registered as a juristic person under Thai law.

4. Must be a foreign juristic person under the Foreign Business Act B.E. 2542 (1999) and must have received an investment promotion certificate under the Investment Promotion Act.

5. Must be a foreigner or a juristic person recognized by law as a foreigner who brings foreign currency into the Kingdom, withdraws money from a non-resident baht account, or withdraws money from a foreign currency deposit account. This money can be used to purchase a condominium.

6. Foreigners or foreign juristic persons may own condominium units up to 49% of the total unit area in each condominium building.

Although selling condominiums to foreigners is a form of real estate investment with a high chance of success and good returns, there are strict procedures and legal requirements that require detailed scrutiny. Investors and real estate developers must thoroughly study and comply with the law to avoid future problems. They must also constantly monitor changes to the terms and conditions, as these laws are subject to change at any time in response to changing domestic situations.
