Land seizure is not actually the same as property confiscation or enforcement of a judgment. According to Section 83 of the Land Code, a land seizure is not a confiscation, but rather a preventative measure to avoid the transfer of ownership or any other transactions on the land until legal procedures have been completed.

What is a Land Seizure?

A land seizure is a request to suspend the registration or changes to the land registry for a certain period. This prevents any transactions concerning the land, including buying, selling, disposing of, transferring, or changing ownership, during the seizure period.

The seizure applies only to the land itself, not to structures built on it, such as houses, buildings, or other structures.

Who Has the Right to Request a Land Seizure?

According to Section 83 of the Land Code, only those with a vested interest in the land may request a land seizure, which could allow them to sue for registration or changes to the land registry.

The interested parties include:

1. Those named in the land sale agreement, such as Mr. A as the seller and Mr. B as the buyer. Once the contract is finalized, if Mr. A fails to fulfill the agreement, the buyer (Mr. B) can request a land seizure to prevent Mr. A from selling the land to someone else.

2. Those entitled to inherit the land, such as when the landowner dies without a will specifying ownership.
Therefore, if there are more than one heir and they cannot reach an agreement, the land must be seized to prevent its sale while an executor of the estate has not yet been appointed.

3. Spouses, in cases where the land is marital property.
The person requesting the seizure must not only have a direct interest in the land but also be in a position to enforce registration or changes to the land registry, such as suing to register the sale of the land.

General creditors, such as those under a loan agreement, cannot request a seizure because they do not have direct rights to the land.

Principles of Land Seizure:

1. Application for Land Seizure: The applicant must submit an application to the land officer at the Land Office. 1. The land is located on [the specified land].

2. Only land can be seized. Other real estate, such as houses, buildings, and structures, are not eligible for seizure. Even if there are structures on the land, only the land itself can be seized.

3. The issue being seized must not involve any ongoing court proceedings. Seizure under Section 83 of the Land Code is for the purpose of pursuing court action; a seizure cannot be requested after a court case has already been filed.

4. The land officer has the authority to investigate the evidence presented by the applicant, without needing to investigate the owner of the seized land.

5. For the land officer to accept the seizure, the applicant must provide evidence demonstrating a vested interest in the land, which may allow for a lawsuit to enforce registration or changes to the land registry. Examples include a land purchase agreement or proof of inheritance rights. This evidence does not include witness testimony.

6. The seizure is valid for 30 days from the date the land officer orders it. Upon expiration of the specified period, the seizure immediately terminates, and a re-seizure for the same case cannot be requested.

7. In cases where an interested party objects that the seizure is unlawful, the authorized officer has the power to investigate the necessary evidence.

If it is believed that the seizure was unlawful, the authorized officer has the power to revoke it.
