Buying a House While Single

If you bought the house, whether with cash or a mortgage, while single, it is considered your separate property, acquired before marriage. If, after subsequent marriage registration, you wish to add a spouse's name to the property ownership, there will be associated costs:

– A gift fee of 0.5% of the appraised value.

– Withholding tax according to the Revenue Department's regulations. Since adding a name is considered a sale of real estate, the giver is treated as the seller and must pay personal income tax only on the portion given to the spouse.

For example, if a house valued at 4 million baht is split equally between spouses (2 million baht each), the tax will be calculated using the 2 million baht portion determined by the Land Department's appraised value from the Treasury Department.
This will be used to deduct expenses based on the number of years of ownership, then divided by the number of years of ownership, and finally calculated according to the tax bracket.

– Stamp duty of 0.5% of the appraised value or the purchase price, whichever is higher. This applies if ownership has been held for 5 years or the name has been on the house registration for 1 year. However, if ownership has been held for less than 5 years and the name has been on the house registration for less than 1 year, a specific business tax of 3.3% of the appraised value or the purchase price, whichever is higher, will be charged instead of stamp duty.

For cases involving adding a spouse's name. If a couple is married before taking out a house loan or acquires the property after marriage, it is considered marital property. Adding a spouse's name as an owner of the house costs approximately 75 baht in fees.

When changing from a single borrower to a joint borrower, remember that the bank will consider both spouses' income and existing debts.

If a spouse has excessively high debt, the joint loan may be rejected. Therefore, it may be necessary to wait until existing debts are reduced and avoid incurring additional debt.
